Monument Apps, LLC Terms of Service

These Terms of Service govern your use of the website located at https://monumentapps.com, our mobile applications — including UpTo — and any related services provided by Monument Apps, LLC. In these Terms, “the Services” means all of them together, and “the Apps” means our mobile applications.

By accessing the website or by downloading, installing, or using any of the Apps, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing the Services.

If you use an App that lets you post content or connect with other people, our Community Guidelines also apply and form part of these Terms.

We, Monument Apps, LLC, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use

By using the Services, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

1. modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
2. remove any copyright or other proprietary notations from any materials and software on this website;
3. transfer the materials to another person or “mirror” the materials on any other server;
4. knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Monument Apps, LLC provides;
5. use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
6. use this website or its associated services in violation of any applicable laws or regulations;
7. use this website in conjunction with sending unauthorized advertising or spam;
8. harvest, collect, or gather user data without the user’s consent; or
9. use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to Monument Apps, LLC and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Monument Apps, LLC at any time.

User-Generated Content

You retain your intellectual property ownership rights over content you submit to the Services. We will never claim ownership of your content, but we do require a limited license from you in order to store it and show it to the people you share it with.

When you use the Services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and transmit your content solely for the purpose of operating and providing the Services to you and to the people you have chosen to share it with, in a manner consistent with our Privacy Policy. We do not display your content publicly, we do not sell it, we do not use it for advertising, and we do not use it to train machine-learning models.

The license you grant us ends when you delete the content or your account. Deleting your account removes your posts, photos, comments, and connections, and we do not retain a commercial right to anything you have deleted. Backups and moderation records are the only exceptions, and both are described in our Privacy Policy and Community Guidelines.

You give us permission to use the display name and profile photo associated with your account in order to show them to the people you are connected with, in a manner consistent with our Privacy Policy.

Using the Apps

Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may only use the Apps with the involvement of a parent or legal guardian. We do not knowingly allow children under 13 to create accounts, and we will terminate any account we learn belongs to one.

Your account

You sign in with Apple, with Google, or with a code sent to your email address. You are responsible for keeping access to that identity secure and for everything that happens under your account. Tell us at hello@monumentapps.com if you believe someone else is using it.

You may delete your account at any time from inside the App. Deletion is permanent and removes your posts, photos, comments, connections, and sign-in identity.

Who can see what you post

UpTo is private by design. What you post is visible to the friends whose connections you have accepted, and is not published to a public feed, ranked by an algorithm, or shown to people outside your connections. It is not, however, secret: anyone who can see your content can photograph or copy it, and we cannot control what they do with it afterwards. Post accordingly.

No tolerance for objectionable content or abusive users

We have no tolerance for objectionable content or abusive behavior. You agree not to post, upload, share, or transmit content that is unlawful, harassing, bullying, hateful, defamatory, pornographic or sexually explicit, violent or threatening, exploitative of children, invasive of another person's privacy, deceptive, impersonating, spam, or otherwise objectionable. The Community Guidelines describe each of these categories in detail and form part of these Terms.

You also agree not to harass, threaten, stalk, or abuse any other person using the Services.

Reporting, moderation, and enforcement

Every post, comment, and profile can be reported from inside the App, and any account can be blocked. We review reports ourselves, and we act on those that establish a violation.

We may remove content and may suspend or terminate any account, at our sole discretion and without prior notice, where we believe these Terms or the Community Guidelines have been broken. Content that sexually exploits or endangers a child results in permanent termination and is reported to the appropriate authorities.

App stores

Where you obtain an App through a third-party app store, your use is also subject to that store's terms. These Terms are between you and Monument Apps, LLC, not with Apple or Google, and that store operator is not responsible for the App or for providing support for it. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Monument Apps, LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Monument Apps, LLC or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Monument Apps, LLC or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of Materials

The materials appearing on our website are not comprehensive and are for general information purposes only. Monument Apps, LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Links

Monument Apps, LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Monument Apps, LLC of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of United States. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
